These General Terms and Conditions apply to all contracts for services provided by Trimowa UG (limited liability) – hereinafter referred to as "Trimova" – in particular in the areas of goods handling, load securing, operational on-site support, and logistics consulting for companies within the meaning of § 14 BGB (German Civil Code).
Trimova provides services in accordance with the individual agreements in the offer or individual order. A contract is concluded upon written confirmation by the customer (including by email) or upon commencement of work by Trimova.
If the services are provided at the customer's location (on-site teams), the customer shall ensure that the teams have unhindered access to the place of work and that all necessary safety instructions and technical requirements are in place on site.
The customer is obliged to provide Trimova with all information necessary for the proper execution of the order (e.g., weights, dimensions, material properties, special safety requirements) in a timely and complete manner.
All prices are exclusive of statutory sales tax. Unless otherwise agreed, invoices are due for payment without deduction within 14 days of the invoice date.
Trimova is liable for damages resulting from injury to life, limb, or health in accordance with the statutory provisions. In the case of other damages, liability is limited to intent and gross negligence. Liability for simple negligence is limited to the foreseeable damage typical for this type of contract. Unless explicitly agreed otherwise, the maximum liability amounts are based on the statutory provisions of the German Commercial Code (HGB).
Short-term cancellations of firmly booked on-site assignments (less than 24 hours before the start of the assignment) may be subject to a cancellation fee if Trimova is unable to use the capacities elsewhere.
The law of the Federal Republic of Germany applies. The place of performance and exclusive place of jurisdiction for all disputes arising from or in connection with this contract is Saarbrücken.
